RecBytes Terms of Use

Welcome to RecBytes ("RecBytes," "we," "us," or "our"). This free webservice is provided on an "as is" basis. By accessing or using RecBytes, you ("you" or "your") signify your agreement to the following Terms of Service ("Terms"). If you do not agree with any part of these Terms, do not use our services.

1. Account Creation

• You must be at least 18 years old to use RecBytes.

• To create an account, you must provide accurate and complete information.

• Maintaining the confidentiality and security of your account credentials is your responsibility.

• You must immediately notify us of any unauthorized account access or use.

2. Service Usage

• RecBytes grants you a limited, non-exclusive, non-transferable license to access and use the webservice in accordance with these Terms.

• You are responsible for the activity occurring within your RecBytes account.

3. Prohibited Conduct

You must not use RecBytes to:

• Violate any applicable laws, regulations, or third-party rights.

• Transmit any material that is unlawful, harmful, offensive, defamatory, abusive, threatening, or hateful.

• Conduct spamming, phishing, or other malicious activities.

• Attempt to interfere with, disrupt, or gain unauthorized access to the service or its related systems and networks.

• Reverse engineer, decompile, or disassemble any part of RecBytes.

4. No Fees

• RecBytes is a free service. There are currently no fees or charges associated with its use.

5. Intellectual Property Rights

• RecBytes and its licensors retain all rights, title, and interest in and to the RecBytes service, including its software, technology, trademarks, and any associated intellectual property rights.

• You may provide us with suggestions or feedback. Any such feedback will be considered non-confidential, and we may use it to improve RecBytes without any obligation to you.

6. Disclaimer of Warranties

• RECBYTES IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• WE MAKE NO GUARANTEE THAT RECBYTES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ASSUME NO RESPONSIBILITY FOR ANY DOWNTIME, SERVICE DISRUPTIONS, OR INACCESSIBILITY.

7. Limitation of Liability

IN NO EVENT SHALL RECBYTES, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF RECBYTES, EVEN IF RECBYTES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless RecBytes and its affiliates, directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of RecBytes in violation of these Terms.

9. Termination

• We may terminate or suspend your account and access to RecBytes immediately, without prior notice or liability, if you breach these Terms.

• Upon termination, your right to use RecBytes will immediately cease.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via your registered email or by a prominent notice on our website.

11. Governing Law and Jurisdiction

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the state of Washington.
